Luxe Stone Exchange Services (“Luxe Stone ES”), powered by Accruit and operating under all applicable laws governing Qualified Intermediary services, offers a one-time referral fee as a courtesy and expression of gratitude for your trust in referring your first client to our services. This referral fee is payable only upon the successful closing of the first 1031 Exchange transaction resulting directly from your referral.

By submitting a referral, you acknowledge and agree to the following terms:

One-Time Payment: The referral fee is a one-time payment and is only applicable to the first successfully closed transaction directly resulting from your referral. No further compensation, residuals, or fees will be paid on any future transactions by the same client or any affiliated parties unless otherwise agreed to in a separate, written agreement signed by an authorized officer of Luxe Stone ES.

Eligibility and Timing: Referral fee eligibility is contingent upon the referred client’s full disclosure of the referring party at the time of initial engagement with Luxe Stone ES. Referral must be made in good faith, prior to client contact with Luxe Stone ES. Referral fees are issued only after the successful completion of the exchange transaction and the disbursement of exchange proceeds.

Compliance and Licensing: Referral payments are subject to compliance with all applicable federal, state, and local laws, including but not limited to real estate, tax, and financial regulations. It is the referring party’s responsibility to ensure they are legally permitted to receive such compensation under applicable law and any relevant licensing authority.

No Agency Created: The referring party shall not be considered an agent, partner, employee, or representative of Luxe Stone ES. No agency, joint venture, or employment relationship is created by this referral program.

Indemnification and Hold Harmless: By participating in this referral program, you agree to indemnify, defend, and hold harmless Luxe Stone Exchange Services, its parent companies, subsidiaries, affiliates, officers, employees, agents, and partners from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your referral, including but not limited to any failure to comply with applicable laws, misrepresentations made by the referrer, or disputes related to compensation.

No Guarantee of Payment: Luxe Stone ES reserves the right to determine eligibility for referral fee payment at its sole discretion. Referral fee amounts and payment timelines are also subject to internal approval processes and may vary based on transaction size and complexity.

Modification and Termination: Luxe Stone ES reserves the right to modify or terminate this referral fee program at any time, with or without prior notice, provided that any changes shall not affect fees already earned under prior qualified referrals.

By submitting a referral to Luxe Stone Exchange Services, you acknowledge that you have read, understood, and agree to be legally bound by the terms above.
